Legislation United Kingdom

Donation:

  • The retrieval and use of tissue for transplantation is governed by the Human Transplant Act 2004. This requires that consent is obrained before the removal of tissue for the purpose of transplantation, research, or eduction/training. Either the donor must have given consent during his/her lifetime (e.g. donor card, National Organ Donor Register) or a niminated representative/family member must give consent.
  • The storage of tissue for transplantation is licensed by the Human Tissue Authority.

Cornea banking:

  • The EU Tissues and Cells Directive 2004/23/EC requires therapeutic tissue banks to be licensed/accredited.
  • The Human Tissue Authority is the Competent Authority for the purpose of the EU Directive.
  • Guidance on eye donation has been prepared by the Royal College of Ophthalmologists (www.rcophth.ac.uk). Standards are reviewed by the Ocular Tissue Transplant Standards Group of the RCOphth, which includes representatives of all the eye banks.
  • The British Association for Tissue Banking provides a forum for all tissue banks.
